Permanent appointments made on Aug 4 in compliance with IT rules: Twitter tells Delhi High Court

Social media giant Twitter on Friday told the Delhi High Court that it has made permanent appointment of officers on August 4 in compliance with the country’s new Information Technology (IT) rules. However, the central government said it needed to confirm this information. The High Court said that the next hearing in the matter will be on August 10.

Minister of State for Electronics and IT Rajiv Chandrasekhar told Parliament on Thursday that Twitter has appointed a Chief Compliance Officer and a Resident Grievance Officer as a contingency arrangement, but has not designated a nodal contact person. Chandrashekhar said that on May 26, 2021 (the day the new rules for social media were implemented), Twitter failed to appoint a non-compliance officer, nodal contact person and resident grievance officer. “Later, they appointed a Chief Compliance Officer and a Resident Grievance Officer as a contingency arrangement. Twitter has also not designated a nodal contact person and the matter is sub-judice.” Social media platforms like Twitter are intermediaries as defined in the Information Technology (IT) Act, 2000.

In order to ensure accountability of social media platforms to users and enhance user safety, the government has notified the Information Technology (Intermediate Guidelines and Digital Media Code of Conduct) Rules, 2021, which came into force from May 26, 2021, the Minister said. Said. He said that in case of non-compliance, the middlemen are liable to lose their exemption under section 79 of the IT Act, 2000.
