I am a big fan of our Puranas, itihas and epics… There are many examples of unconventional births in our epics… This government always says that it takes inspiration from these Puranas. But this law which he has prepared is not inspired by liberal Hindu epics. In fact, this law was drafted by someone who has a regressive, colonial and Victorian mindset. This law does not come from Hindu liberal traditions…. I will tell you why.
This law excludes many people instead of joining it. While I have given you many examples of unconventional births and unconventional unions in our Hindu epics, this law allows only married people to have access to this technique. It does not allow LGBTQ people access to this technology. It does not allow single men access to this technology. So, this law is actually a Victorian law; This is not Hindu law.
So never say that you are a government which is actually propagating Hindu values. Hindu values are liberal values. In fact, you are promoting Victorian colonial value.
This law does not take into account the new realities of India. Of course, these new realities are not new realities. These were in our ancient scriptures. The unions that they had always been there were suppressed by the colonial mindset. These unions should also be provided access to this technology. LGBTQ populations, live-in couples and single men should also have access to this technology if they wish.
This law is discriminatory… This law is again patriarchal. This is again the identity of this government and the identity of what it says. A person who is able to donate eggs must be married and have a child who is at least three years old; Only then can she become a donor. A single woman cannot be a donor. Once again this pattern of patriarchy….
The Surrogacy Bill was passed in this House without any debate. That bill is currently pending in the Rajya Sabha. Therefore, it has not yet become a law. But the bill says there is going to be a monitoring board that will draw its powers from the Surrogacy Act. Why are you bringing this bill when this bill has not become law? There are many conflicts between these two laws….
