‘Father laid the foundation of security’: Man gets 25 years in jail for raping minor, grandmother gives justice

A special court in Mumbai on Monday sentenced a 37-year-old man to 25 years imprisonment for raping his 13-year-old daughter after he was found guilty of charges under the Protection of Children from Sexual Offenses (POCSO) Act. While pronouncing the sentence, the court commended the victim’s 60-year-old grandmother for “seeking justice at such an age” for her granddaughter.

Special Judge Bharti Kale observed that the accused caused immense pain and trauma to his own daughter and also directed that a compensation of Rs 15,000 be paid to the minor under the Victim Compensation Scheme.

“A father lays the foundation for security, trust and love. A father secures his daughter’s life and saves her from getting hurt. But the victim’s father himself has given her unbearable pain. Childhood trauma is bound to affect the victim. The court is confident that it will deal with it with the help and guidance of various agencies set up under the POCSO Act.

As reported by The Times of India, the girl was repeatedly sexually assaulted by her father in 2020, but the incident came to light in May 2021 when she narrated her ordeal to her grandmother, who then sought justice for her granddaughter. Decided to ask The victim lived in a small room with her father, grandparents, uncle and two siblings.

The 60-year-old woman, who is the mother of the accused, informed the police about the incident and also produced her in the court.

The victim told the court that her father used to rape her in a corner of the room and threatened her with dire consequences.

In their defence, the accused claimed that the incident could not have happened as they lived in a crowded area and the victim could have raised her voice for help.

“The failure of the victim to shout certainly does not in any way cast doubt on her evidence as the person in authority and on whom the victim’s life depended, had committed such acts. The main reason for the victim’s failure to cry out was The reason is the fear in the mind of the children that if a close relative does such an act then what will happen to their life if they protest as the uncertainty of the future, what will happen to their mind. It is real when children are not safe in their own home and they are afraid of the outside world,” the court said.

Further, the court also took cognizance of the senior citizen and said, “Grandmother is to be commended for seeking justice even though she would be required to look after the children of the accused at such an age.”
