The HC was hearing a petition filed by Shukla, seeking quashing of the FIR and transfer of the probe in the case to the CBI, which is already investigating the case against former Maharashtra home minister Anil Deshmukh. Still working.
Shukla’s counsel Mahesh Jethmalani pointed to the court’s affidavit filed by the police in which he has said that Shukla has not been named as an accused in the FIR.
Senior advocate Darius Khambata told the HC that the petitioner is yet to be named as an accused but investigation is on to find out who was responsible for the leaking of sensitive government documents.
The bench then observed that if Shukla has not been named as an accused and if the police does not intend to take his name, the court should not waste its time in hearing the petition.
“If his (Shukla) name is not being taken, why should we hear this petition? We are not just wasting judicial time,” the bench said.
“You (police) should clarify whether she will be named as an accused or not. Then, when she is named as an accused, she can go to court again,” the HC said.
The court has fixed October 25 for the next hearing of the case.
Shukla, in his plea, alleged that he was being made a scapegoat and targeted by the Maharashtra government for submitting reports on alleged corruption in police transfers and postings.
The petition further states that the State Intelligence Department (SID) she was heading at that time had taken necessary permission from the Additional Chief Secretary of the State Government before monitoring.
Shukla is presently serving as Additional Director General of Central Reserve Police Force (CRPF) South Zone and is posted in Hyderabad.
Shukla, in his petition, said that he has exposed the alleged nexus between ministers and politicians and other gross corruption involved in handing over postings to police officers.
An FIR was registered at Mumbai’s BKC Cyber ​​Police Station against unidentified persons for allegedly illegally tapping phones and leaking certain confidential documents and information.
The alleged phone tapping took place last year when Shukla was the head of the SID.
