The applicant, through advocate Jitesh Duhilani, had earlier argued before the court that he was suffering from ED since 2019, making him impotent.
While granting confirmed anticipatory bail, the court has ordered the applicant to deposit personal and surety bonds of Rs 25,000 as well as a solvent surety of equal amount. The applicant was also requested to appear in the police station every Thursday till the filing of charge sheet.
The court granted bail to Makhijani considering his undertaking to hand over his mobile phone to the investigating officer and to appear for the medical examination prescribed for him by the police during the course of investigation. He was also regularly urged to avoid instilling fear in the complainant or influencing any witness.
While granting bail, the court also said that custodial interrogation of the applicant is not required and the investigating agency has been given sufficient time to investigate the matter.
Additional Public Prosecutor AM Mahurkar had earlier argued that the investigation process was still on and the mobile phone of the accused was required to be recovered from him. Defense counsel Duhilani had argued that the arrest would cause all kinds of inconvenience to the applicant, despite his acquittal.
It is learned that Makhijani was booked for rape following a complaint by a woman who worked as his domestic help last year. She had joined Makhijani as housekeeper and help in September last year.
In her complaint, she claimed that she was sexually assaulted by Makhijani in October last year, following which she left the job the following month. He also claimed that Makhijani did not clear his dues.
