When Uddhav’s lawyer Sibal reached the Supreme Court on Tuesday, the court said – after the hearing of a case in the constitution bench is over on Wednesday, it will hear the case. Now the Supreme Court will hear this case on Wednesday at 3.30 pm.

On the other hand, after the Maharashtra Legislative Assembly, now the Shiv Sena office of Parliament has also been given to the Shinde faction. The Lok Sabha Secretary informed about this through a letter. Earlier, the Shinde faction had taken over the office of the Shiv Sena in the Maharashtra Assembly on Tuesday.

Thackeray faction in SC cited party constitution
The petition by the Uddhav faction had said that the Election Commission, in settling the dispute over the name and symbol of the Shiv Sena, based the party’s 1999 constitution, though it had been changed in 2018. In the amendment, it was said that the president will be at the top in the Shiv Sena. The final decision on the inclusion, removal or meeting of someone in the party will be taken by the party president.

The Uddhav faction had said that according to the 1999 constitution, the party chief had no such power. He alleged that the Election Commission did not even give time to put the 2018 Constitution on record. The new constitution has been ignored while taking the decision. On the basis of this argument, the Uddhav group had demanded a stay on the decision of the Election Commission till the decision of the Supreme Court.
