Will Mukul Roy be PSC President? High Court reserved decision

The High Court has reserved judgment on Mukul Roy’s tenure as the chairman of the Public Accounts Committee or PSC. The hearing of the case ended on Wednesday in the High Court. However, the High Court did not give any decision today.




BJP MLA Ambika Roy has filed a case in the High Court demanding the dismissal of Mukul Roy from the post of PAC President. BJP MLA’s lawyer CS Baidyanath raised questions on the court saying that the practice of nominating the chairman of the Public Accounts Committee from the opposition camp is going on for the last 54 years. Mukul Roy has now moved to the grassroots level. In such a situation, Mukul Roy has been made the President of PAC. When the matter came up for hearing on August 24, the judge wanted to know whether there was any political sanction for becoming the chairman of the Public Accounts Committee. At the same time, he also had a question whether the PAC president has come from the opposition party? A division bench of Acting Chief Justice Rajesh Bindal and Justice Rajarshi Bhardwaj sought the views of both the government and the plaintiff’s lawyers on the issue.

An affidavit has been filed in the court on behalf of the state. The affidavit states that as per Article 212 of the Constitution, if a matter is pending in the Legislative Assembly, it has no jurisdiction over the decision of the judiciary. Although this is the statement of Trinamool and Mukul Roy, yet he is the BJP MLA from Krishnanagar on paper. So if he is the PAC president then there is no hurdle.
