How long the jury members argue is almost entirely up to them.
While we await the next verdict, we know more about the jury and their deliberations in the case.
Amid incidents of unrest and rioting in Kenosha, Rittenhouse, 17, carried an AR-15-style rifle and joined a group of other armed men in the city on August 25, 2020.
Rittenhouse, now 18, faces one count for each of the four men in those incidents, as well as one count for allegedly endangering a journalist who was not far behind Rosenbaum.
The most serious of those charges is first degree intentional homicide for Huber’s murder. Comes with a compulsory sentence of life imprisonment if the charge is proved.
Who’s on the jury?
Thus eighteen jurors sat throughout the trial for two weeks. On Tuesday morning, six of them were dismissed via a random drawing in which Rittenhouse himself selected juror numbers from a Tumblr.
According to the pool reporter in court, the remaining 12 members of the jury are five men and seven women. The dismissed alternate jurors were asked to remain in the courthouse while the jury was considering the case.
Where are they talking?
The jury members reached the courtroom at 9 am on Tuesday and started deliberating shortly after.
During jury selection, Schroeder told potential jurors that there was a “less than 1 percent chance” that he would be prosecuted, although he did not rule it out.
Schroeder said that each day, the jury meets at the same location and then goes to court in a bus that has its windows covered so that jurors can’t see any signs or political messages outside the courtroom.
Kenosha Police said the man was briefly detained and issued several traffic citations. A spokesperson for NBC News confirmed that a freelance employee found a traffic citation near the jury bus and said that he never intended to contact or photograph jurors.
How long will they discuss?
The members of the jury will deliberate on each of the five charges until a unanimous decision is reached. This process can take hours, days or even weeks.
It is not clear how long the jury will deliberate each day until night. On Tuesday, the jurors ended their first day of deliberations just before 7 p.m. CT. On Wednesday, from 9 am to 4:30 pm, they discussed by whistling. They discussed again on Thursday morning at nine.
Judge Schroeder said he would not put restrictions on how long they last and said he preferred to take votes among jurors.
The decision must be unanimous. If jurors deliberate for a long time and do not reach a unanimous decision on one or more cases, the judge may declare a wrong decision. This is commonly referred to as a “hung jury”.
What questions have they asked?
Jury members can send notes to the court with questions about the law, about the evidence, or even just about logistics.
How do we know that the verdict has come?
The jury members will alert the court that the verdict has been reached, and the court will alert the media via email. After that the decision will be pronounced in the court.
The judge said there would be a sufficient amount of warning time between when the judgment would be pronounced and when it would be read. He declined to specify for how long, but said, “You can probably make it to Chicago on time, as long as it’s not a Friday night.” Chicago is just an hour’s drive from Kenosha.
