A court here has framed charges for various offences, including rioting, against two accused in the 2020 northeast Delhi riots case related to the alleged attack on a school in Brijpuri here. Hindu. According to the complaint, the mob set ablaze the school’s computer lab, library and several other items, causing a loss of around Rs 1.25 crore.

“I am accused Shamim Ahmed and Mohd. Kafeel to be prosecuted for offenses under sections 147 (rioting), 148 (rioting, armed with deadly weapon) 427 (mischief causing damage of Rs 50 or more) 435 (mischief with intent to cause hurt by fire or explosive substance) Could 100 rupees or more) IPC sections 149 (guilty of offense committed in prosecution of common thing) and 436 IPC read with 188 (mischief by fire or explosive substance with intent to destroy house), etc. . (Disobedience to order duly promulgated by public servant of IPC),” Additional Sessions Judge Pulastya Pramachala said in an order passed on Tuesday.

The third accused Faizan was absconding and was declared a proclaimed offender in the case.

The judge said that based on the statements of the witnesses, there was “sufficient material” to show that the accused along with other unknown members of the crowd had formed an unlawful assembly with a common object.

The judge said that in pursuance of their common object, they attacked and forcibly entered the school with a common object to cause as much harm as possible. “It is also clear that this school was chosen because it belonged to Hindus and the common object of the said mob was to damage the properties of Hindus,” the judge said.

The court noted that the armed mob ransacked and torched the school’s computer lab, library and vehicles as well as other belongings and properties.

The court, however, acquitted the accused persons of the offense of criminal conspiracy. “Since the allegations of conspiracy are based on conjecture rather than any concrete evidence, I do not find it sufficient to hold that the accused persons acted in a premeditated conspiracy,” the court said. Dayalpur police station had registered an FIR against the accused.
