SC Seeks Delhi LG’s Response on AAP’s Plea for Early holding of MCD’s Mayor Election

New Delhi: The Supreme Court on Wednesday sought the response of the office of the Lieutenant Governor of Delhi, pro tem presiding officer of MCD Satya Sharma and others on a plea filed by Aam Aadmi Party (AAP) mayoral candidate Shelly Oberoi seeking early mayoral elections. was demanded. For civic body. A bench comprising Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala said it is seeking their response by next Monday by issuing notice on the petition. Senior advocate AM Singhvi said that the session of the house was called three times but the mayor was not elected.

“We have several objections, including that the pro tem presiding officer of the MCD is insisting on holding simultaneous elections for mayor, deputy mayor and members of the standing committee. This is contrary to the Municipal Corporation of Delhi Act. ” Taking note of Singhvi’s submissions, the bench said it would hear the matter on Monday.

Both the BJP and the AAP have accused each other of stalling the mayoral election, the root of the dispute being the appointment of aldermen and their voting rights in the House. AAP, which has a majority with 134 out of 250 elected members, alleged that the BJP was trying to steal its mandate by giving voting rights to nominated members.

Oberoi had earlier also approached the apex court seeking a direction to ensure time-bound election of the Mayor in Delhi, but the petition was withdrawn in view of the elections to be held on February 6.
The apex court had on February 3 said that the main grievance of the petitioner was that the mayor was not elected, but now the election was notified and he was given liberty to come back in case of any grievance.

The mayoral election in the national capital was stalled for the second time last month as the MCD House was adjourned sine die by the presiding officer appointed by the lieutenant governor following an uproar by some councillors.

The first meeting of the newly elected MCD House was also postponed on January 6 amid clashes between AAP and BJP members.
