Rajya Sabha polls: Shiv Sena MLA Suhas Kande moves HC against EC for invalidating his vote

Shiv Sena MLA Suhas Kande approached the Bombay High Court on Monday Election After the Commission of India (ECI) declared his vote in last week’s Rajya Sabha elections invalid, the BJP alleged that he violated the voting process.

Kande, in his petition, filed through advocate Ajinkya Udane, said that his dignity and reputation had been seriously adversely affected by the EC’s decision to discharge his vote, and demanded that the HC quash and set aside the EC’s decision. Keep it

Udane mentioned Kande’s petition before a division bench of Justice SV Gangapurwala and Justice Dheeraj Singh Thakur and sought urgent hearing. The court fixed June 15 for hearing on the petition.

Kande, in his petition, claimed that on June 10, when the Rajya Sabha elections were held for six seats in Maharashtra, he had gone to the election hall (at the Vidhan Bhavan in Mumbai), exercised his right to vote, extended necessary support. Ballot paper and as per rules, came out and showed the ballot paper to Shiv Sena leader Sunil Prabhu, who had issued the whip for the election.

“MLA Yogesh Sagar alleges that the petitioner had shown his ballot paper to the whip of some other political party. This is not true and the petitioner had shown his ballot paper only to Sunil Prabhu and not to any other political party.

The petition said that Sagar should have raised this objection at that time and not after Kande had left the election hall.

It further claimed that the election officer in-charge of the polling station had given his verdict that the allegations made by Sagar were not factually correct and that Kande’s vote was valid.

However, later in the evening, several BJP leaders met the Election Commission regarding the same complaint. The petition said that no notice was served to the petitioner (Kande) and without seeking reply of Kande, the Election Commission thought it appropriate to interfere with the decision taken by the returning officer and invalidate Kande’s vote.

Shiv Sena’s Sanjay Pawar lost to BJP’s Dhananjay Mahadik in a tight contest on Friday for a total of six seats in Maharashtra. Shiv Sena and its allies NCP and Congress won one seat each. The BJP had contested on all three seats.
