Rajasthan Power Project: High Court cancels allotment of public utility land to Adani near Pokhara

Jaipur: In a setback to Adani Renewable Energy Park Rajasthan Limited (AREPRL), the High Court on Tuesday, June 29, 2021, ordered the cancellation of allotment of a public utility land near Pokhran in Jaisalmer to a firm owned by the Adani Group.

In 2018, AREPRL was given 6,115 hectares of land at Nedan village near Pokhran in Jaisalmer region to build a power plant.

A division bench of Rajasthan High Court Justice Sangeet Lodha and Rameshwar Vyas ordered the state government to conduct a survey of land parcels allotted to AREPRL and Essel Surya Urja Company of Rajasthan LD (ESUCRL) in three villages.

The court also directed that if any part of these lands is given to public utility, the allotment should be cancelled.

The court issued these orders in response to a petition filed by Barkat Khan and 23 others opposing the allotment of public utility land by the state government to solar generating corporations.

The state government should also review the extent of the properties of the petitioners, the assets of other khatedar tenants and the assignment of public utilities property, as per the high court’s decision. This will be done to ensure that their rights are not violated as a result of getting land allotment to ESUCRL and AREPRL.

The Court ordered that the land of the khatedar tenants and the land for the approach road to the dhani of the residents of the village be set aside and recorded in the tax records for this purpose.

The Court further said that the State Government should carry out the entire exercise in accordance with this judgment within six weeks of the receipt of the certified copy of the order.
