During the hearing, Khan’s counsel referred to an earlier order which held that the post of Life President and Life Member in NSF is illegal. “He (Batra) was specifically informed by the Government of India. Yet when Hockey India was registered as a society on May 28, 2009 under the Societies Registration Act 1860, and was immediately recognized by the Government of India, R-3 (Batra) went ahead and established itself as a Hockey Society. Appointed as a Life Member of India. It smacks of shamelessness towards the clear mandate of the law. It was a less than sincere but futile attempt to institutionalize itself in a body whose legitimacy is in conformity with the Sports Code and the law,” read the order.

It further said: “What a paradox, to make oneself permanent in an institution whose tenure is itself temporary. The illegal office of President or Life Member cannot be a stepping stone to any other position or advantage, whether at the national level (including the Indian Olympic Association) or in international bodies. If R-3 (Batra) has made so much profit, then such profit or position will stand forfeited immediately. Let the CoA look into the matter and let the Government of India do the same.”
