Advocate LK Charles Alexander, in his petition, also alleged that the filmmaker has used names of historical figures in his film to “protect” the “deliberate defamation of history” by the Central government.
The petitioner also submitted that history is common to all and cannot be used for commercial gains. He also mentioned that Mani Ratnam has not shown the real history and distorted the facts to suit the character’s story in the film.
The petitioner has also stated that the Government and the Archaeological Survey of India, which is responsible for maintaining and regulating the archaeological activities and history of the country, should have taken strict action against the Director. He also alleged that the government body has failed to do so and alleged that the Dil Se Director has violated the provisions of the Antiquities and Art Treasures Act 1972 and the Ancient Monuments and Archaeological Sites and Remains Act 1958.
The petitioner has stated that he had made a representation to the Archaeological Survey Department of the State Government India (ASI) and the Central Board of Film Certification (CBFC) will investigate the matter. However, there was no response, he approached the High Court seeking appropriate action. Alexander urged the Madras High Court to provisionally direct the Union Ministry of Culture, the ASI and the CBFC to take action against Ratnam and “deliver justice”.
