Murder Mystery Series-7: Such a story of the murder of a doctor’s daughter and a servant, in which the murderer made the big officers of the CBI into a rage

The seventh story of the Murder Mystery series is from Noida. Very high profile. The doctor couple were accused of killing their own daughter and killing the servant. CBI started investigation. Proved guilty and sentenced to life imprisonment. The High Court overturned the case, but left so many questions unanswered. The suspense was created step by step. The top officers of CBI could not prove the charges even after 14 years. Let’s tell the same story today…

Keep in mind that this whole story is based on the things told through the investigative agencies. We try to explain the whole case in the same way as told by the officials.

Aarushi was the only daughter of the doctor couple
Renowned dentist Rajesh Talwar lived in Noida’s Sector 25 Jalvayu Vihar. On the night of 15 May 2008, at around 11 o’clock, there was a problem of WiFi in his laptop, then he went to the room of his 14-year-old daughter Aarushi. Opened the computer kept there and started doing some mailings. Aarushi was reading Chetan Bhagat’s 3 Mistakes of My Life during that time. Aarushi’s mother Nupur also came in a while. Now mother and daughter were talking and father emailed.

Aarushi and the servant saw Hemraj doing wrong
After sometime Rajesh and Nupur went to their room. Here the housekeeper Hemraj went to Aarushi’s room. After some time Rajesh came out of his room for some work and saw that the door of Aarushi’s room is slightly open. When I looked, Aarushi and Hemraj were in an objectionable condition. Rajesh is red with anger. Run away and pick up the golf stick kept next to the kitchen.

The door of the room opened quickly and Hemraj was hit very hard on the head. Hemraj’s head exploded. Rajesh hit him again with a golf stick. This time Hemraj stepped aside. The blow went straight to Aarushi’s head. After this Nupur Talwar also came from the other room. Rajesh told the whole thing to Nupur and then both of them started trying to hide Hemraj’s dead body and become unaware of the murder.

Rajesh and Nupur Talwar took Hemraj’s body to the terrace. Put one side there. Put the lid of the cooler on top of it. Rajesh felt that Hemraj might not be saved, so he took a surgical blade from below and cut the vein of Hemraj’s neck. When he came down, Aarushi’s neck was also cut with a surgical blade. The two then changed clothes and kept the golf stick and surgical blade in the car and went to throw them away. When he came back, he locked the gate from inside and started waiting for morning.

When morning came, Nupur said, Hemraj killed Aarushi.
Apart from Hemraj, Bharti was also a servant at Rajesh Talwar’s house. She used to go home at night. She came at 6 in the morning of 16 May. The gate was closed. Ring the doorbell 3-4 times. Nupur came rubbing her eyes and said, is he not Hemraj? Bharti said, even after so much sound, he did not come out. Nupur tried to open the lock of the gate but it did not open. Gave the key to Bharti. Bharti opened the lock by putting her hand inside.

When Bharti and Nupur went inside, Rajesh Talwar was standing crying. When Nupur saw Aarushi’s body, she started crying loudly. Said to Bharti, “Look Bharti, Hemraj killed Aarushi.” Bharti’s tears also come out. She cries and asks should I call the neighbors? Nupur shook her head yes. Rajesh Talwar called his family members before informing the police. The police arrive at 6.50 pm.

Rajesh Talwar and Nupur took the first name of Hemraj for the murder in front of the police. Hemraj was from Nepal, so a team of police left for Nepal. The very next day after the murder, the police started going to the terrace for investigation. The lock on the ladder was locked. When asked for the key, Rajesh Talwar gave it. When he went upstairs, he was stunned to see Hemraj’s body. Now the suspicion of the police increased. Till now the police was assuming Hemraj to be guilty, but after getting his body, IG Police Gurdarshan Singh called the case an honor killing and arrested Rajesh Talwar on 23 May 2008.

When CBI got the case, got Talwar’s narco test done
At that time there was a Mayawati government in the state. When people raised questions on the investigation, the case was transferred to the CBI. CBI got Rajesh Talwar’s Narco test done, but nothing was found. After this the investigation team started questioning the servants Rajkumar, Vijay Mandal and compounder Krishna, who worked in Rajesh’s clinic. No evidence was found here.

There is confusion in the closure report of the CBI
The CBI sent the report to Special Judicial Magistrate Preeti Singh in September 2009. Preeti Singh rejects CBI’s closure report. Said, check again. Now another team of CBI got the responsibility of investigation. Its leadership was handed over to AGL Kaul. The other team released all the three servants of the Talwar family. Chargesheet was filed in specially constituted CBI court in Ghaziabad.

Rajesh Talwar was made an accused in the charge sheet. As evidence, the CBI wrote some things –

  • No one else will come to cover Aarushi’s body, clean her private parts.
  • After the murder of Hemraj, how his body was brought to the terrace, when the lock of the ladder was locked.
  • According to the CBI, there was no evidence of any outsider coming inside the house.
  • After transporting Hemraj’s body to the terrace, Rajesh Talwar drank a lot of alcohol and destroyed the evidence.

Based on these evidences, on November 25, 2013, a special CBI court sentenced Rajesh Talwar and Nupur Talwar to life imprisonment under section 302/34. Apart from this, both were found guilty of section 201 for destruction of evidence and sentenced to 5 years in prison. According to the court, now Nupur and Rajesh will have to stay in jail for the rest of their life.

Allahabad High Court CBI rubbished the argument of
Rajesh Talwar challenged the CBI’s decision in January 2014 in the Allahabad High Court. When the court saw the CBI’s argument, it told nonsense. The judge said, there are only stories in this, where is the evidence? Understand the arguments given by the court-

  • Where are the golf sticks and surgical blades used in the murder case?
  • Why did not Hemraj’s blood stains be found on Rajesh and Nupur?
  • Rajesh and Nupur were interrogated separately, but no difference was found.
  • Nothing was found in the narco test of Rajesh and Nupur, which would prove them guilty.

On 16 October 2017, a division bench of Allahabad High Court Justice BK Narayan and Justice AK Mishra overturned the CBI’s decision. In this way Rajesh Talwar and Nupur were acquitted, but they were not declared innocent but got the benefit of Doubt i.e. 100 guilty should be acquitted but 1 innocent should not be punished here. When they saw the verdict, Rajesh and Nupur, who were lodged in Dasna Jail in Ghaziabad, wept. Nupur said, “Now we have got justice.”

The decision of the Allahabad High Court felt its defeat for the CBI. The CBI challenged the decision in the Supreme Court. Hemraj’s wife was made the medium of appeal. On 10 August 2018, the Supreme Court accepted the petition. Till now the hearing is going on continuously. The verdict is awaited.
