Modi Surname Comments: A new judge of the Gujarat High Court will hear today (April 29) Congress leader Rahul Gandhi’s appeal challenging the Surat Sessions Court order staying his conviction in a criminal defamation case over his Modi surname remark .

According to the cause list published by the High Court on Thursday (April 27), Justice Hemant Prachhak will hear Gandhi’s appeal on April 29. Earlier on Wednesday (April 26), Gandhi’s counsel PS Champaneri mentioned the matter before Justice Gita Gopi. , he recused himself from the hearing by saying “not in front of me”.

The development came a day after Gandhi moved the High Court. A metropolitan magistrate’s court in Surat on March 23 convicted the former Congress president under sections 499 and 500 (criminal defamation) of the Indian Penal Code (IPC) in a 2019 case filed by the Bharatiya Janata Party (BJP) Gujarat. Following the verdict, Gandhi, who was elected to the Lok Sabha from Kerala’s Wayanad in 2019, was disqualified as a Member of Parliament (MP) under the provisions of the Representation of the People Act. Gandhi challenged the order in a sessions court in Surat with an application seeking a stay on the sentence. Granting him bail, the court refused to stay the sentence on April 20.
