Sharing details about the incident, Chaturvedi said that on February 2, 2013, the man kidnapped the girl, who was then 15 years old, and raped her when her mother had gone to a relative’s house. Did. Upon his return, the mother lodged a complaint against him, alleging that he stole a motorbike, Rs 1.05 lakh in cash and jewellery.

On the complaint of the woman, an FIR was registered under sections 363 (kidnapping), 366 (kidnapping, abducting or forcing woman to marry) and 376 (rape) of the Indian Penal Code.

The ADGC said that four years after the death of her first husband, the woman had married the now convicted man, a resident of Aligarh, who was expected to support the family. After marriage, both started living together in Mathura district.

The ADGC said the defense counsel requested the court to take a lenient view in the matter as his client is poor and a first time offender. The judge dismissed the petition saying that since the accused is the father and guardian of the girl, what he did was a heinous crime and deserved an exemplary punishment.

He said that the guilty also deserved severe punishment as the girl was under 16 years of age when he subjected her to the crime. The ADGC said that the judge then sentenced the convict to rigorous imprisonment for 10 years and a fine of Rs 50,000 under IPC section 366, and life imprisonment (till last breath) and a fine of Rs 1.50 lakh under section 376. If the convict fails to deposit the fine, the government will pay Rs 2 lakh as compensation to the victim, the bail of the convict will be cancelled, the judge ordered.
