Life imprisonment to ‘minor’ convict of murder in Hisar: ADJ court’s decision, age was 16 years 3 months at the time of incident; This is the third case of such punishment after changing the law regarding Nirbhaya case.

The verdict has come in Hisar on Friday in a murder case. In this case, Court 2 of Additional Sessions Judge Ajay Teotia was hearing the accused, who were minors at the time of the incident. Two days ago, one of them was acquitted and the other was convicted. On Friday, the court sentenced the convict to life imprisonment and a fine of Rs 10,000. However, the matter regarding the other 8 accused is pending in the second court. The special thing is that this is the third such case after Delhi’s Nirbhaya rape case, when the court has given such a heavy punishment to a minor. Even before this, in a rape case, the court of Hisar has given a verdict of 20 years imprisonment to a juvenile.

According to the information received, on June 12, 2018, Naveen, a resident of village Ugalan in Hisar district, had lodged a case of murder of his father Ramesh in the Bamboo police station. In the complaint, Naveen had told that on May 31, 2018, at around 5 pm, he was exercising at Vidya Academy Ugalan. When the sound of quarrel was heard, he reached the spot. There Krishna alias Kala, Jagdish, Rajesh, Mandeep alias Jahri, Sonu, Dashrath, Sanjay and two others were attacking his father with weapons. After this the accused absconded, Naveen took his father Ramesh Kumar to the hospital. He died during treatment there on June 12.

On 7 February, the JJ Board had sent the matter to the District Court.
The matter reached the court. As two of the accused were minors, the hearing was held in the Juvenile Justice (JJ) Board. Considering both the minors as mentally and physically adults, the board sent their case to the district court on 7 February 2021. The board had commented that both the minors should be treated like adults in the case. After this, the court of ADJ Ajay Teotia was hearing the case of both of them.

On July 28, one acquitted and the other convicted
On July 28, the court of Teotia had acquitted a minor (at the time of the crime) and convicted the other minor accused. On Friday, the court has sentenced one of them to life imprisonment and a fine of 10 thousand rupees. According to the records, the age of the convict was 16 years three months at the time of the incident.

This has happened for the third time so far after the Nirbhaya case, the second decision of the Hisar court
Let us inform that after the Nirbhaya gang rape and murder case carried out in the capital of the country on December 16, 2012, the Hisar Court has sentenced the minor convict to a second major punishment. In September 2018, the minor convict in the 2017 Uklana Gudiya rape case was sentenced to 20 years of imprisonment by the court. Overall, this is the third such case so far.

What happened in Nirbhaya case?
In fact, before the Nirbhaya rape case, the minor accused involved in the crimes were heard in the JJ Board itself. After the misdemeanor committed by the minor involved in this case, there was a provision of punishment like an adult with the minor involved in the heinous crimes. There was a demand to make strict laws for women’s safety, and Justice Verma Committee was formed. The 2013 legal amendments went into effect. At the same time, changes were made in the Juvenile Justice Act in 2015, the age limit for the accused to be considered a criminal in cases like murder-rape was reduced from 18 to 16.
