The Karnataka High Court on Tuesday dismissed various petitions challenging the ban on hijab in educational institutions. The court said that wearing hijab is not an essential practice related to religion. Here’s everything you need to know:

  1. Despite the Karnataka government’s February 5 order, the Karnataka High Court ruled that the current ban on wearing the hijab in educational institutions would continue.
  2. Dismissing all the writ petitions of girl students or girl students, the court declared that educational institutions have the right to prescribe uniforms.
  3. The court also said that the Karnataka government’s order banning hijab in educational institutions is not unconstitutional.
  4. Describing the court’s decision, the Chief Justice said that from a holistic perspective, the court framed some questions and answered them accordingly.
  5. The court considered whether the hijab is a required religious practice, whether it is guaranteed under Article 25, whether the prescription of school uniforms is a violation of rights, and whether the government is arbitrary and violates Articles 14 and 15 of the Constitution. does.
  6. Considering all this, the court ruled that the hijab is not a compulsory religious practice under the Islamic faith, which is protected under Article 25.
  7. The Karnataka government’s February 5 order barred students from wearing any clothing that could disturb peace, harmony and public order.
  8. Six girls from a college in Udupi had approached the Karnataka High Court seeking relief and quashing of the government order.
  9. The full bench of the High Court is hearing the matter daily from February 10.
  10. The Karnataka High Court bench in its interim order had asked the state government to reopen educational institutions.
