Mumbai: A two-judge bench of the Bombay High Court recused itself from hearing the bail plea of Delhi University Associate Professor Honey Babu and the plea of Gautam Navlakha, both accused in the Elgar Parishad-Maoist link case, without assigning any reason. Babu said the unsigned letter which the NIA claimed was found on the computer of Babu’s co-accused Rona Wilson, was neither written by him nor addressed to him. Babu said it did not mention his role in the alleged conspiracy. His petition, filed through advocates Yug Choudhary and Payoshi Roy, was mentioned before a vacation bench of the high court last month. At that time, the vacation bench had directed that the petition should be heard by a regular bench of the High Court.
On Wednesday, when Babu’s petition came before the bench of Justice Revati Mohite-Dere and Justice VG Bisht, the bench recused itself from hearing it without assigning any reason. Justice Mohite-Dere also recused himself from hearing a petition filed by Navlakha, who has sought, among other things, access to telephone calls at Taloja Jail in Navi Mumbai, where he is currently serving as an undertrial prisoner. in is closed.
Navlakha, 71, has been lodged in the high-security Anda Cell of Taloja Jail since October last year. In his plea, Babu said that Special NIA Judge DE Kothalikar had made a “mistake” in saying that the letter showed prima facie existence of objectionable material against him.
The judge had said that the letter spoke of “a conspiracy to assassinate Rajiv Gandhi” to kill Modi and had convicted Babu in the case. Judge Kothalikar made the remarks in February this year while rejecting Babu’s bail on the ground of merit.
Challenging the order of the NIA court, Babu filed his appeal in the HC last month. Babu further stated in his plea that there is no evidence to suggest that he intends to create dissent against India, or supports it.
The plea said that the trial of the case is yet to begin, and it will take time to conclude as the NIA had cited more than 50 witnesses, and the chargesheet was of 30,000 pages. He appealed to the High Court to grant him bail.
Babu, who was arrested from his residence in Delhi in July 2020, is also lodged in Taloja jail. The petitions of Babu and Navlakha will be heard before an appropriate bench later this month.
