A vacation bench of Justices Manish Pitale and Neela Gokhale heard a petition filed by Dhanashree Jagtap, seeking permission to re-appear in the exam.

The Bombay High Court on Thursday allowed an 18-year-old girl to re-appear in the National Entrance Test Undergraduate (NEET-UG), which is being conducted for students from Manipur, for the second time, as she could not clear the exam. Had pie Paper for the first time due to a broken wrist.

A vacation bench of Justices Manish Pitale and Neela Gokhale heard a petition filed by Dhanashree Jagtap, seeking permission to re-appear in the exam. According to Jagtap, she reached the NEET-UG exam center on May 7, but due to the crowd in the queue, she fell on the ground, fracturing her right wrist joint.

Jagtap said in the petition that she was taken to a nearby hospital and later brought back to the center where she was allotted a scribe. Although the time duration of the exam was three hours and 20 minutes, she started the exam late but was not given extra time to finish her paper due to which she could not attempt the last part related to Physics subject, Jagtap said in the petition.

Jagtap, in his plea seeking a direction to the National Testing Agency to allow him to re-appear, said that though the NEET-UG exam is conducted only once every year, this year due to the sudden outbreak of violence in Manipur. Because NEET-UG 2023 exam is being conducted separately for the students of that state. The re-examination of Manipur students is to be held on June 6 in Bengaluru, Karnataka.

When the petition came up for hearing on Thursday, the central government said it was ready to allow Jagtap to re-appear in the exam on June 6, but on the condition that he would not rely on the marks obtained in the May 7 exam. Accepting this, the court said that Jagtap shall be permitted to appear in the NEET-UG 2023 examination along with students from Manipur at a center in Bengaluru, adding that the concerned authority shall take appropriate steps to facilitate his appearing in the said examination. The HC said, “The petitioner shall file an affidavit within a week from today that she will not rely on the attempt given on May 7, 2023 for NEET-UG 2023 examination.”
