Aryan will remain in jail for now: NDPS court did not grant bail to Aryan, Arbaaz and Munmun; The application could not be filed even in the High Court.

The bail application of Aryan Khan, accused in the Cruise Drugs Party case, has been rejected once again. On Wednesday, the special NDPS court in Mumbai refused to grant bail to Aryan, Arbaaz Merchant and Munmun Dhamicha. Operative order was issued from the first court.

After getting the detail order, Amit Desai and Satish Manshinde on behalf of Aryan reached the courtroom of Justice Nitin Sambre to mention the bail petition, but by then this bench of the High Court had risen. After this Manshinde told Dainik Bhaskar, ‘Till now we have not been able to file the petition, we will tell you when the petition is filed.’ At the same time, Amit Desai said, ‘We will try to file the bail petition again tomorrow’.

The first operative order was issued by the NDPS court on Aryan’s bail.

Aryan’s lawyer and Shahrukh’s manager reached the High Court
Aryan Khan’s lawyer Amit Desai and Shahrukh Khan’s manager Pooja Dadlani had reached the High Court for the bail application. Munmun Dhamicha’s lawyer Ali Kashif Khan had also reached the High Court, but due to the delay, none of the petitions could be filed.

Aryan, who was arrested on October 3 in the cruise drug party case, has been lodged in Mumbai’s Arthur Road Jail since October 8. Aryan has got the batch of prisoner number 956 in the jail. Aryan’s 14-day judicial custody also ends on October 21.

NCB’s argument against bail
Opposing Aryan’s bail, ASG Anil Singh had said that records and evidence show that Aryan has been taking drugs regularly for the past few years. The ASG said that Aryan is very influential and there is a possibility of tampering with evidence or fleeing the country if released on bail. Singh further said that Aryan and his friend Arbaaz have been arrested on the basis of solid evidence.

The NCB had said that the foreign links of the drugs racket have to be investigated. This is a big conspiracy which needs to be investigated. Arbaaz used to take drugs from Arbaaz, so he should not be given bail. The NCB also placed a WhatsApp chat in the court and claimed that the investigation of this chat has revealed that Aryan Khan has an important role in the drugs case.

Aryan’s drug chat with actress blocked bail
NCB has also got some chats of Aryan, in which Aryan has discussed drugs with an emerging actress. During the hearing on October 14, the NCB presented this chat before the court as evidence. It is also being said that the actress was present on the cruise and was initially let go by NCB. In the coming time, this actress can also be questioned by NCB. This conversation of Aryan with the actress is being considered as a big hindrance in his bail.

Some of Shahrukh’s fans also reached outside the court demanding Aryan’s release.

Defense put this argument for Aryan’s bail
Earlier on October 13, the hearing went on for about 3 hours, but the debate could not be completed. During this, the defense debated on the sections from the Panchnama of the Narcotics Control Bureau (NCB) to the accused to get Aryan bail. He said that no drugs were recovered from Aryan. Nor has NCB received any cash. The person who invited Aryan to the party is not arrested. Aryan has no connection with Munmun Dhamecha.

Desai’s allegation – Aryan was forcibly taken statement
Aryan’s lawyer Amit Desai has also described Aryan’s confession as a forced statement. Desai said that the NCB is saying that Aryan has confessed that he was about to take charas with Arbaaz, but the court also knows how to get things done.

Who are the lawyers appearing for the accused, NCB?
ASG Anil Singh is looking into this matter on behalf of NCB and is being assisted by Advocate Shriram Shirsat in the court. Shirsat was also assisting ASG in the Riya Chakraborty drugs case in the Bombay High Court. SPP Advait Sethna is also representing NCB.

Senior advocates Satish Manshinde and Amit Desai are appearing for the accused, especially Aryan. Both are considered to be Mumbai’s veteran lawyers in such cases. Riya Chakraborty in the Sushant drugs case by Manshinde and Salman in the hit and run case by Desai got relief from the court. This is the reason that during the hearing of October 14, there was a tremendous fight between the two sides.

BJP MLA prayed for Aryan’s bail
BJP MLA from Ghatkopar West assembly seat in Maharashtra, Ram Kadam has prayed for the release of jailed Aryan Khan. Ram Kadam said, getting bail is a fundamental right under the constitution and law, but the Uddhav government has stood in support of the drug mafia.

Ram Kadam tweeted, ‘Praying that Aryan Khan gets bail today. Getting bail is a fundamental right under the Constitution and the law. This is not a fight against one particular individual, but the war against drugs of the entire human race.
