Aryan Khan’s crime ‘will be bailable’, says senior lawyer Majeed Memon, but Rizwan Merchant denies – read more! – times of India

ETimes revealed a while back that Shah Rukh Khanson of Aryan Khan, who has been arrested by Narcotics Control Bureau (NCB) was charged under sections 8C, 20B, 27 and 35 of the NDPS Act, following a drug raid.

ETimes got in touch with Senior Counsel Majeed Memon, for his opinion on the charges and Aryan’s chances of securing bail. Talking specifically to us, Memon Said, “The accused is allegedly a member of the rave party from where certain banned material was found in violation of the provisions of the NDPS Act. It appears that the quantity allegedly attributed to him for personal consumption is small and not commercial quantity and hence the offense would be bailable.

However, senior advocate Rizwan Merchant had some differences of opinion. When contacted Aryan’s allegations, he said, “Section 35 presumption of culpable mental state and Section 27 is a fee for consumption. But the charges are non-bailable as 20B is less than the commercial quantity but greater than the small quantity. 8(c) is an allegation of possessing cannabis, so it would read with 8(c) 20(b), depending on the quantity he has. The punishment could be 10 years and a fine. But no Minimum punishment was not given.”

Earlier in the day, Shah Rukh Khan’s elder son Aryan Khan was arrested by the Narcotics Control Bureau (NCB) after raiding a cruise ship and busting a drugs party on Saturday. Arbaaz Khan Merchant and Munmun Dhamecha were also arrested along with Aryan and taken into custody.
