17 year old PIL for implementation of Mental Health Act in Delhi HC

New Delhi: The Delhi High Court on Monday sought the response of the capital government on a petition related to the mental health of students in schools and colleges. Devina Singh, a 17-year-old student, had filed a PIL seeking implementation of the Mental Health Act, 2017 in educational institutions.

A bench of Justice DN Patel and Justice Jyoti Singh issued notice and also sought a response from the Institute of Human Behavior and Allied Sciences, New Delhi.

In the PIL, Singh, represented by senior advocate Sonia Mathur, argued that children and adolescents are vulnerable to mental disorders and the health system does not prioritize mental health on the basis of India’s National Mental Health Survey 2015-16. Is. It has claimed that stress, fear, depression, insomnia, disconnection and lack of self-confidence, are widely prevalent issues among students, but are not addressed.

According to a PTI report, the petition states that there is no comprehensive assessment, evaluation and diagnosis/protocol/standard operating procedure (SOP) with respect to mental health of students unlike physical health, where periodic assessment and Follow-up action is taken. interval. It also talks about a direct link between academic stress and performance and sound mental health and that if left untreated, mental disorders in children can lead to more complex disorders, school dropouts, addiction and self-harm. Huh.

The plea also states that the COVID-19 pandemic has had a huge psychological impact on students, resulting in parental anxiety, disruption of daily routines, increased family violence, and little or no access to peers. This is due to acute and chronic stress. , teacher, or physical activity. The petition, filed through advocate Rahul Kumar, has sought mandatory presence of clinical psychologists, counsellors, social workers and mental health professionals in every school and college in the district to assess the mental health of the students.

A direction has also been sought to the authorities to implement the National Mental Health Program for the benefit of the students and to conduct mental health surveys on regular basis/periodic intervals.
