मंगेतर से रेप, फिर मांगलिक बताकर शादी से इनकार: हाईकोर्ट ने कुंडली जांच का आदेश दिया, अब सुप्रीम कोर्ट ने रोक लगाई

The Supreme Court on Saturday stayed the order to check the horoscope of the rape victim. This order was given by Justice Brij Raj Singh of Lucknow Bench of Allahabad High Court on 23 May. Actually, a girl has accused her fiance of rape. The girl says that after having a physical relationship, the fiance refused to marry her, calling her Manglik.

On this, the court ordered the chairman of the astrology department of Lucknow University (LU) to check the horoscope of the girl within 10 days and tell whether she is Manglik or not. The next hearing in the case was to be held on June 26, but on June 3, the Supreme Court, taking suo motu cognizance, stayed the order of the High Court.

On June 15, 2022, a girl from Chinhat area of ​​UP’s capital Lucknow lodged a case against Govind Rai alias Monu at Chinhat police station. The girl said that she was stopped by Govind, a resident of Nizampur Malhaur. After this, Govind raped her on the pretext of marriage. He works as a laborer living in Punjab. When the victim pressured her to marry, she refused to marry citing Manglik Dosh i.e. Mangali in her horoscope.

What did the victim tell the police?
The victim told the police that on June 16, 2020, he was stopped with Govind. After this, we started talking through phone and video calls. My father died on 19th April 2021. After this, on 20 April 2021, Govind came to my house in Malhaur with his mother.

At night when all the members of the house were sleeping, Govind forcibly tried to have physical relations with me. When I refused, Govind said that we are going to get married in a few days, so what is the problem in having a physical relationship?

After this, Govind raped me continuously for 4 days against my will. Then for two years we kept talking through video calls. When I asked Govind about marrying him, he would hesitate.

Later he told that he is going to marry someone else and has blocked my number. Govind threatened me that if I told anyone about my relationship with him, he would make my private photos and videos viral.

The Lucknow bench of Allahabad High Court gave this decision on 23 May.

After registering a case on behalf of the victim, the police arrested the accused Govind. The accused filed a bail application in the High Court. During the hearing, the counsel for the accused said that the girl is Manglik, so my client cannot marry her.

Advocates Ravindra Kumar Singh, Anjali Dubey, Manoj Kumar Singh, Rajiv Kumar Mishra and Soni Pathak appeared in the court on behalf of the victim. He told the court that the victim is not Manglik. The accused raped her on the pretext of marriage.

Govind’s lawyer Sonia Mishra says that my client has been framed. If the victim was raped then why was the case filed after a year? Why did the victim refuse medical? We have full faith in the court. We will accept whatever decision the court gives.

Lucknow University will have to give report in 10 days
After listening to the arguments of both the sides, the High Court has said in the order dated 23 May 2023 that the accused had made a false promise of marriage to the girl. He never wanted to marry the girl.

The court had ordered the Head of the Department of Astrology of Lucknow University to tell within 10 days whether he is Manglik or not after seeing the horoscope of the victim.
