On this, Uddhav’s lawyer Kapil Sibal asked the court to hear the matter soon. He argued that the assembly office of the Uddhav faction has already been captured. If the stay is not granted by the court, then the Shinde faction will take away the office and bank account as well.

Uddhav Thackeray had reached the Supreme Court on Monday against the decision of the Election Commission. The court asked them to file the petition on Tuesday. When Uddhav’s lawyer Sibal reached the Supreme Court on Tuesday, the court said – after the hearing of a case in the constitution bench is over on Wednesday, it will hear the case. Now the Supreme Court will hear this case on Wednesday at 3.30 pm.

Sanjay Raut said – now trust only on the Supreme Court
On the decision to take away the name and symbol of Shiv Sena from the Election Commission, Uddhav faction leader Sanjay Raut said on Tuesday that all institutions have ended in this country. Democracy has been murdered, so now there is only one hope left – the Supreme Court. We will go there and demand justice.

Thackeray faction in SC cited party constitution
The petition by the Uddhav faction had said that the Election Commission, in settling the dispute over the name and symbol of the Shiv Sena, based the party’s 1999 constitution, though it had been changed in 2018. In the amendment, it was said that the president will be at the top in the Shiv Sena. The final decision on the inclusion, removal or meeting of someone in the party will be taken by the party president.

The Uddhav faction had said that according to the 1999 constitution, the party chief had no such power. He alleged that the Election Commission did not even give time to put the 2018 Constitution on record. The new constitution has been ignored while taking the decision. On the basis of this argument, the Uddhav group had demanded a stay on the decision of the Election Commission till the decision of the Supreme Court.

Shinde faction's chief whip Bharat Gogavale along with other MLAs reached the assembly, where he met Speaker Rahul Narvekar.
