New Delhi: The Supreme Court has directed the Maharashtra Police not to file a chargesheet in the FIR registered against former Mumbai Police Commissioner Param Bir Singh and also sought the views of the CBI to take over the investigation.
A division bench headed by Justice Sanjay Kishan Kaul, however, allowed the Maharashtra Police to continue with its investigation and asked the Central Bureau of Investigation (CBI) to file an affidavit within a week, in the FIR registered by the Maharashtra Police. Senior advocate Darius Kambatta, appearing for the Maharashtra government, argued that Singh’s plea was not maintainable as it was a service dispute against the departmental inquiry, which should be contested before the Central Administrative Tribunal.
Justice Kaul told Kambatta, “Prima facie we find it difficult to accept it. Let’s not go into the specifics, but since the case has already been handed over to CBI, why can’t it be handed over to them also?”
Earlier, after Singh’s counsel told the bench that he was very much in the country and he was not absconding, the apex court granted him interim protection from arrest and directed him to join the probe.
