NOIDA: The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) on Thursday said it has decided to reject the registration applications of two projects of developer Supertech Ltd. The decision has been taken on the failure of Supertech to complete its projects already registered with RERA. and for failure to comply with the orders of the Authority giving relief to home buyers, it said.
However, RERA said that it has decided to give the promoter a second chance to re-apply for registration of these two projects after being able to adequately comply with the previous orders of the authority.
“UP RERA in its 63rd meeting held under the chairmanship of Rajeev Kumar on 24th June decided to reject the application for registration of two proposed projects of Supertech Limited, namely Golf Country GH 01- Phase-1A and Golf Country GH 01- By using Step-1B. Its powers under Section 5 of RERA are read with Section 4(2)(b) and Section-11(4)(b),” said RERA Secretary Rajesh Kumar Tyagi .
“This has been done in view of the fact that the promoter has failed to complete a large number of its projects within the time limit announced to RERA and also failed to comply with a large number of orders passed by the Authority on complaints filed by the house The promoter is the buyer of the company’s projects,” he said in a statement.
Tyagi said the authority had held a personal hearing of the promoter on June 23 before arriving at the decision.
He said the authority had sought a detailed compliance report of its orders and a concrete action plan from the promoter to complete its projects.
“During the hearing, the company’s chairman RK Arora told the authority that the company is trying to complete the projects and comply with the orders of the authority,” he said.
“The Authority did not find the written or oral responses of the promoter satisfactory and came to the conclusion that it would not be appropriate and further, it would not be in the interest of the home buyers to approve the registration of two new projects of the company. Has not been able to complete a large number of projects already registered.”
He also said that the company has also defaulted in complying with a large number of orders passed by the authority giving relief to the aggrieved home buyers of the firm.
RERA Chairman Rajeev Kumar said the promoter was not complying with the orders of the authority and there was no “obvious improvement” in the status of compliance with the orders pending at the promoter’s end.
Kumar said, “The promoters have also not been able to give a concrete action plan to complete their ongoing projects, as a result of which a large number of home buyers of the promoter are motivated to approach the authority with complaints for relief. “
He said that the promoter has not only failed to speed up his projects but has also failed to comply with the orders of the authority, which has added to the woes of the home buyers.
Kumar further added, “It was paramount for the authority to protect the interest of home buyers and ensure the provisions of the Act and Rules from the promoters.”
“The authority will do everything in its power to ensure justice to the home buyers and compel the promoters to complete their pending projects,” he said.
