New Delhi: The Supreme Court on Tuesday will hear a plea by the Trinamool Congress party seeking contempt action against the Tripura government and others for failing to reduce violent incidents against opposition parties in the upcoming local body elections. .
A bench of Justices DY Chandrachud and AS Bopanna on Monday said it will hear the plea on Tuesday after advocate Amar Dave, appearing for TMC, submitted that the situation in the state was getting worse despite the court’s November 11 order.
“There was an incident yesterday. The situation in the state is very unstable and it has gone from bad to worse. The situation is getting worse day by day,” he said. He added that repeated incidents of violence were taking place. and false cases are being registered against their members, hence the petition for contempt action has been filed.
When the bench asked whether the petition has been filed, Dave said it is in the process of being filed and once the number is in place, he will provide it to the court.
“Well, we will hear it on Tuesday. Once the petition is numbered, you provide the details to the Court Master”, the bench said.
On November 11, the top court had directed the Tripura government to ensure that no political party, including the TMC, is prevented from pursuing electoral rights in accordance with law and from conducting peaceful and orderly campaigns for the state’s local body elections. Go. Manner.
The top court had also directed the state government to make appropriate arrangements to ensure law and order for free political participation in municipal elections. It had issued notice to the state government on a petition by TMC and its Rajya Sabha MP Sushmita Dev, alleging widespread violence against party workers and representatives, seeking protection.
“Since the commencement of the election process, it is the bounden obligation of the Respondents (Government of Tripura) to ensure that any political party which is in the fray shall be allowed to exercise its electoral rights in accordance with the law and in a peaceful and orderly manner. Propaganda is not prevented in any manner,” the top court had said.
Necessary arrangements will be made for enforcement and compliance along with the law enforcement machinery of the State and appropriate action will be taken by the Secretary, Home Department, Government of Tripura as well as the Director General of Police. This order, it was said.
The top court had said that with regard to the petition for personal protection, the concerned superintendent of police, who has been included as a party to the petition, with regard to the perception of danger with respect to each case and area, shall decide and take necessary action. . “An affidavit shall be filed by the first respondent (Government of Tripura) explaining the steps being taken in pursuance of the present order and even to ensure that the election process is conducted during the upcoming municipal elections in Tripura. Be free and fair.” said.

The local body election process began after the notification on October 22 and polling will be held on November 25. Polling for one municipal corporation, thirteen municipal councils and six nagar panchayats in Tripura will be held on November 25.
