Supreme Court on Gyanvapi: If Shivling is found, keep it safe, Namaz should not be stopped, this is the balance in our eyes

The Supreme Court has issued a big direction on the petition of the Muslim side against the order of the Varanasi Court to conduct a survey of the Gyanvapi Mosque in Varanasi. The Supreme Court said that the place where Shivling was found in the premises should be kept safe. The top court also said that people should not be stopped from offering namaz. The hearing was held in a bench of Justices DY Chandrachud and PS Narasimha.

The Supreme Court told Hufaiza Ahmadi, appearing for the Muslim side, that this petition is for worship and not for ownership. On this Ahmadi had said that in such a situation the situation there will change. The Supreme Court has also issued notice to the Hindu side in this matter.

Justice Chandrachud directed – If Shivling is found then we have to strike a balance. We will instruct the DM to protect the place, but Muslims should not be stopped from namaz.

3. The order of only 20 people offering Namaz is no longer applicable.

Muslim side: During the hearing, Huzaifa Ahmadi, appearing for the Muslim side, said that the way the worship has been demanded, it will only change the situation. Ahmadi said that the same court had said that the religious places in which they were on August 15, 1947, cannot be changed. There is a lot of potential for conspiracy in such an order (Varanasi Court).

He said how can you seal the premises. There is a flurry of illegal instructions. If you seal the premises, it will be in violation of the order to maintain status quo. You order a stay of all the decisions of the lower court.

UP Govt. Tushar Mehta said that Shivling has been found in Vajukhana, which is a place to wash hands and feet. The place of prayer is different. He further said that if permission is given to offer Namaz, the Shivling can be damaged. Mehta further said that if someone sets foot on the Shivling, the law and order situation may get affected.

Supreme court : During the hearing in the court, Justice DY Chandrachud said that this matter is not proprietary, permission has been sought to worship. The Supreme Court further said that we will order that the application filed by you, the civil court should dispose of it soon. After hearing both the sides, the court ordered that if Shivling is found, then it should be kept safe. Also, the prayers should not be stopped. The court said that the next hearing will be held on May 19. Both the Hindu side and the Muslim side were involved.

Muslim side objected to judge speaking Shivling
During the hearing in the Supreme Court, when the judge used to speak at the place of Shivling, then the Muslim side objected to it. The Muslim side said that the matter is still disputed. In such a situation, the place where Shivling is found should not be called, after which Justice Chandrachud said that we will indicate it in the order.

Controversy has been going on for hundreds of years regarding the Gyanvapi Masjid adjacent to the Kashi-Viswanath temple in Varanasi. It is believed that in 1699, the Mughal ruler Aurangzeb demolished the original Kashi Vishwanath temple and built the Gyanvapi Mosque.

Shivling was found during the survey, the trial court had banned the entry there.
