Supreme Court gives notice to Bihar government on the appointment of SK Singhal as DGP

The Supreme Court of India has served notice to the Bihar government and asked it to answer why SK Singhal has been appointed as the Director General of Police (DGP). Singhal is the acting DGP of the state. The top court has also asked why it did not pursue a contempt of court case against the Bihar government which did not comply with the apex court’s direction and appointed Singhal as the DGP.

Senior advocate Jay Salve, appearing for the petitioner in the court on Monday, said that the apex court has repeatedly directed the Bihar government but later it did not pay heed. The Supreme Court of India had given a clear direction to the administration of all the states and union territories not to appoint substitute DGPs. Singhal is also handling the charge of DGP in Bihar.

“We pointed out that the apex court had earlier given notice to the Jharkhand government. Despite this, the Bihar government has done the same wrong. Subsequently, the court has given notice to the Bihar government and asked it to answer why it would not.” Contempt of court proceedings against the state government,” Salve said.

“As per the Supreme Court guidelines, the State Governments and Union Territories are required to recommend to the Union Public Service Commission (UPSC) the names of potential officers, who may be appointed as DGP of a State or Union Territory or three for the post of Commissioner of Police. Shortlists potential officers.The respective state governments or union territories will choose from them and appoint them as police chiefs, Salve said.
