Sibal told the Chief Justice NV Ramana The resumption of full physical hearings on Wednesday and Thursday will hit hard when the pandemic continues to claim lives and suggested that physical presence of advocates should be made optional. “Physical hearing would mean briefings in lengthy cases by five to six advocates, which can create a lot of complications and difficulties,” Sibal said.
The CJI said the court was forced to resume physical hearing due to repeated requests from the SC Bar Association and other advocate bodies. “On Monday and Friday, the court will hear cases through video conferencing and on Tuesday advocates can exercise the option of physical or virtual hearing.”
Sibal said many high courts have opted for the hybrid mode of hearing. The CJI said the decision to resume physical hearing was taken by a five-judge committee. SCBA president Singh opposed Sibal and said, “Senior advocates can take leave for six months or one year or till the pandemic ends. But, the youth in the bar are suffering due to lack of physical hearing.” “This is not an election speech,” Mehta told Singh.
