SC Notice to Centre, Telangana on Andhra Pradesh’s Plea on Division of Assets

The Andhra Pradesh government said it has approached the apex court as “parens patriae” (parents of the nation), claiming that non-division of assets has benefited Telangana as about 91 of them percent are located in Hyderabad.

The Supreme Court on Monday sought response of the Center and the Telangana government on a plea by the Andhra Pradesh government seeking equitable and expeditious division of assets and liabilities between itself and Telangana. union of India and Telangana Govt.

The Andhra Pradesh government said it has approached the top court as “parens patriae” (parents of the nation), claiming that non-division of assets has benefited Telangana as about 91 of them percent are located in Hyderabad.

“The non-division of property has given rise to a number of issues adversely affecting and violating the fundamental and other constitutional rights of the people of the State of Andhra Pradesh, including the employees of the said institutions.

The plea states, “Without adequate funding and actual division of assets in terms of the apportionment made under the Act (Andhra Pradesh Reorganization Act, 2014), the functioning of the said institutions in the State of Andhra Pradesh has been severely curtailed. “

Andhra Pradesh was bifurcated and a new state of Telangana came into existence on 2 June 2014.

The petition states that the number of employees (1,59,096) working in state institutions are hanging in the balance since 2014, simply because proper apportionment has not been done.

“The condition of pensionable employees, who have retired after bifurcation, is pathetic and many of them have not received the final benefits.

“Therefore, it is imperative that all these properties are divested at the earliest and the issue is put to rest,” it said.

The Andhra Pradesh government stated that its institutions are an extension of the state and perform many basic and essential functions.

“Hyderabad (which is now a part of Telangana) was the capital of the United State of Andhra Pradesh. Hyderabad was not only transformed into an economic powerhouse as a result of the ‘Capital Centric Development Model’, but also most of the institutions of governance (intended for the welfare of the people of all regions of the state), including government infrastructure. was specially concentrated and developed in the city of Hyderabad by investing massive resources of the United States,” the petition said.

After the bifurcation of Andhra Pradesh, Hyderabad became the joint capital of the two states and the transitional arrangement is due to expire in 2024.
