RJD chief Lalu Prasad fined Rs 6,000 in 2009 model code violation case, tenders waived

RJD chief Lalu Prasad was fined Rs 6,000 by a court in Jharkhand’s Palamu district on Wednesday for violating the model code of conduct during the 2009 assembly elections in the state. Appearing in the court of Judge Satish Kumar Munda, Prasad admitted that he violated the model code of conduct and tendered an apology.

Judge Munda accepted the apology and imposed a fine of Rs 6,000, which was deposited by Prasad. Thereafter the matter was disposed of.

During campaigning for the 2009 assembly elections, Prasad’s chopper had landed in a paddy field in Garhwa instead of a helipad in Medininagar, allegedly due to pilot error. IPC sections 188 (disobedience to order duly promulgated by public servant), 279 (driving or riding a vehicle in a public manner), 290 (punishment for public nuisance), 291 (Whoever repeats or continues to cause public nuisance) A case was registered under 34 (acts done by several persons in furtherance of common intention), and section 127 of the Representation of the People Act which deals with disturbances in electoral meetings.

Prasad’s lawyer Prabhat Kumar said the matter was later shifted to Ranchi and then to Medininagar. Supporters of the former Bihar chief minister, who gathered outside the court, welcomed the verdict and garlanded their leader.

Sub-Divisional Police Officer (SDPO) Surjeet Kumar said that tight security arrangements were made for Prasad in the court. Traffic was controlled in the area. Prasad had reached Medininagar, the district headquarters of Palamu, to appear in the court on Monday. During his stay at the Circuit House, a fan in his room caught fire, but was swiftly extinguished by his colleagues in a close shave for the 73-year-old leader.

Meanwhile, the special CBI court in Ranchi will hear Prasad’s appeal to issue his passport for renewal on June 10. He has appealed to the court to issue his passport so that it can be renewed as a possible kidney transplant may require him to travel abroad.

Prasad was granted bail by the Jharkhand High Court on April 22 in the Doranda Treasury case, which deals with embezzlement of over Rs 139 crore. In this case, a CBI court sentenced him to five years in jail. Prasad is suffering from several ailments including kidney problems. He is a patient of stage-4 kidney disease.
