Punjab and Haryana HC extends protection to live-in couple, says they ‘deserved’

Chandigarh: On Friday, the Punjab and Haryana High Court granted protection to a couple, a 21-year-old woman and a 19-year-old man, ruling that they are allowed to be together in a live-in relationship as they become adults.

Hearing a criminal writ petition brought by Pushpa Devi and others, a single-judge court headed by Justice Arun Kumar Tyagi issued the verdict. The petitioners have filed a petition under Articles 226 and 227 of the Constitution of India, requesting that the Respondents provide orders protecting the life of the petitioners and liberty from the actions of the Respondents.

“The petitioners in the present case are entitled to be together in a live-in-relationship by virtue of being grown up and are also entitled to the protection of their life and liberty against any damages caused by the respondents Nos. 4 and 5”, as per the report of the Bench. said. live law Website.

The couple had filed a petition requesting protection from the girl’s relatives, who wanted to force her to marry someone else against her will. For the reputation of their family, the couple was also threatened with death by the family.

The petitioners submitted that, even though the boy was 19 years old and had not yet reached the age of majority, the two would get married as soon as they attained the age of marriage. The couple, who were in a live-in relationship, had written a letter to the Senior Superintendent of Police, seeking protection, but no action was taken. The court ordered the police to provide security to the couple based on the relevant decisions of the court.

“In view of the above discussion, the petition is disposed of by the respondent No. 2-Senior Superintendent of Police, District Mohali to look into the grievances of the petitioners as prescribed in the petition and also expressed in the representation dated July 02, 2021, and Take appropriate action for the protection of their life and liberty as may be warranted by the circumstances”, the court said in the report.

In a similar incident last month, the High Court granted police protection to an 18-year-old boy and a 19-year-old girl, who were living together in a live-in relationship.
