Police can’t seize vehicle of drunk driver: Telangana High Court Hyderabad News – Times of India

Hyderabad: Police has no right to confiscate the vehicles of drunken drivers. Instead, they may allow someone who has not drunk to drive a vehicle.
Justice K Laxman said this Telangana High Court Its order came after hearing a batch of petitions filed by vehicle owners, who challenged the confiscation and waited for a long time to get them back.
“If there is no one accompanying the drunk driver, the police should inform any relative or friends of the intoxicated person to take possession of the vehicle,” the order said. The judge said that if no one comes forward to collect the vehicle, only then the police can keep the vehicle in the nearest police station or any other safe custody and it should be released to the owner or any authorized person.
The judge, however, agreed with the contention of G Srikanth Reddy, counsel for the state home department, that a drunk driver should not be allowed to drive from the place where he was apprehended.
