Kanpur: Special Judge POCSO Act Court Rajveer Singh on Wednesday dismissed the criminal appeal of the accused challenging the Juvenile Justice Board’s order passed on September 17, 2021.
The court, in its order, held that the child accused/appellant was charged with the murder of the complainant’s son and destruction of evidence, which clearly shows that his mother had no control over him and was of perverted mentality. Was. There was every possibility that on his release from judicial custody, he might join the company of perverted persons and indulge in criminal activities.
“if Bail given in such cases, it will send a wrong message to the society and defeat the purpose of justice”, the court said. Referring to a judgment of the High Court, the court observed that there was no illegality or irregularity in the order passed by the Juvenile Justice Board.
According to Additional District Public Prosecutor Sushil Kumar Verma, the complainant, mother of the deceased Akash Pal in the case, has said in her complaint that her 19-year-old son was a student of class XII. He used to study with Mrigendra Mishra alias Rachit, a resident of Awas Vikas Colony, Naubasta. He used to visit her house with his tenant Lavkush alias Chotu.
Mrigendra and Chhotu came to his house on 28 April 2021 and took their son Akash on a motorcycle. When his son did not return, he lodged a complaint with Naubasta police station and inquired from Mrigendra’s father about his son. It was later found in the CCTV footage that Mrigendra and Chhotu had taken Akash to some place in their motorcycles. His younger son Aman Pal also told his mother that he had seen Mrigendra, Chhotu and Akash Pal going on a motorcycle.
Last April 29, the police informed him that a body was found under Chakri police circle, which he identified as Akash Pal.
The Babupurwa police had registered a case of kidnapping, murder and destruction of evidence and arrested Mrigendra Mishra, who was later declared a juvenile. The Juvenile Justice Board had rejected his bail application on the report of the probationary officer.
The probationary officer in his report said that there was every possibility that the accused may have joined the company of perverted persons following which the Juvenile Justice Board rejected the bail application on September 17, 2021.
