The court convicted a child in conflict with the law under section 6 (punishment for aggravated penetrative sexual assault). POCSO ACT and 506 (criminal intimidation) of the Indian Penal Code (IPC).
The crime took place in 2021. “The child was living with his aunt after the death of his mother. He was sexually abused at the age of 11 and faced a horrific incident. In the present scenario, crime against children is on the rise and this minor It is necessary to protect the children from the harmful effects of child sexual abuse,” the court said.
“The age of the convict is around 17 years and seven months, therefore, the child who conflicts with the law will be kept in a safe place till the age of 21. After that, will be transferred to the jail. The child who conflicts with the law will be kept in a safe place. Counselling, skill development, psychological support and behavior modification therapy may be provided during the stay in place of safety,” the court said.
The court also awarded a compensation of Rs 2 lakh to the victim under Section 33 (8) of the POCSO Act read with Rule 7 of the Act. The matter has been referred to the District Legal Services Authority for the award of compensation.
