New Delhi: Noida Authority’s decision to select a Mumbai based firm has been approved. Edifice Engineering to destroy both 40 storey tower Supreme Court on Monday directed in Emerald Court Housing Project supertech To execute the contract and obtain approval from all concerned authorities within two weeks.
As the real estate company told a bench of Justices DY Chandrachud and Surya Kant that the demolition would require an NOC including use of explosives, the court directed to make it necessary so that the demolition could start immediately after two weeks.
Supertech also agreed to start refunding the money to the home buyers without any further delay. It said there is a difference in the calculation done by it and the amicus curiae with respect to the amount to be refunded to the homebuyers and it was ready to distribute the amount calculated by it.
Thereafter, the bench allowed the company to refund the amount, but made it clear that it would not adversely affect the claim of home buyers and the final amount would be decided on Friday.
The top court had on August 31 given the company three months to demolish the towers comprising around 1,000 flats, which were built in violation of various rules and building regulations, including safety and fire norms. The deadline expired by the end of November but the demolition work has not even started. The demolition work was to be done by the company at its own expense under the supervision of the Noida authorities. The court had also directed Noida to consult its own experts and experts Central Building Research Institute To carry out the demolition work at Roorkee.
More than 950 flats were to be built in the Twin Towers, including 32 floors, when the Allahabad High Court first ordered their demolition in 2017. 633 homebuyers had booked flats in Twin Towers, out of which 248 had booked flats. Refunds were taken and 133 were transferred to other housing projects of Supertech.
