No bail for Nitesh Rane; Premature application, custody necessary, says Sindhudurg sessions court | Mumbai News – Times of India

MUMBAI: In a set back to MLA Nitesh Raneson of Union Minister Narayan Ranea sessions court judge in Sindhudurg on Tuesday rejected his plea for bail in connection with an attempt to murder case, observing that “for effective investigation of the offense the custodial interrogation… is necessary.”
The Sessions Judge RB Rote also said, “furthermore 11 criminal cases are shown to be registered against the applicant (Rane) including offenses against Public servants” adding that considering the facts and circumstances of the case, if Rane is granted bail, ‘investigation will be hampered.’ The court also noted “two accused are still absconding.”
On December 18, 2021, the police on Kankavali had registered an FIR where Rane and others were accused for plotting to murder a Shiv Sena leader Santosh Parab and allegedly executing the plan by co-accused knocking a four wheeler into the victim’s two wheeler and allegedly assaulting slashing his chest with a knife.
The IO said Rane, 39, and accused number 6 (Sachin Satpute) conspired to “teach a lesson” to the informant given photograph of injured to him and then other accused were hired to execute plan. He said Rane’s phone and ‘Vanity Van’ are required to be seized and custodial interrogation is necessary to confront him with other accused.
The Bombay high court on January 17 rejected his plea for anticipatory bail after he got no relief from a lower court and the Supreme Court on January 27 saw no reason to interfere with the HC order, but gave Rane, a Bharatiya Janata Party (BJP) MLA from Kankavali, 10 days, till February 6 to surrender to the local trial court, himself.
Rane had immediately filed for bail before additional Sessions Judge Rote, Sindhudurg on January 28. His counsel SD Desai and Satish Maneshinde submitted Rane’s innocence, his “false application” was a “classic case of political vendetta” and argued that surrender was not necessary when he submitted to the trial court’s jurisdiction and cited judgments, also argued that on merits too he had a case for regular bail.
His counsel said it was not a knife but allegedly a “paper cutter” and injuries sited by informant were “simple” not serious to attract section 307 (attempt to murder) under Indian Penal Code against him.
Special Public prosecutor Pradeep Gharat vehemently opposed his plea saying it “cannot be entertained” as he has to first surrender before the court. Once he files for bail, the interim protection of breathing time to surrender ends and he needs to be taken into custody first, said Gharat.
Judge Rote in a 19-page rejection order said, Rane filed for bail without filing for his surrender and held his application to be “premature” and “hence not “maintainable” and “deserves to be rejected.”
Meanwhile on Monday, police arrested Rakesh Parab, Rane’s personal assistant and on Tuesday he was remanded to four-day police custody by a Kankavli court. Of 11 accused, seven are arrested and four including Rane not arrested said police.
Rane through his legal team had said before the Bombay High Court that he has nothing to do with the “preposterous” allegations against him, made only as a result of Minister Aditya Thackeray being “lampooned” by Vidhan Bhavan outside BJP activists.
