The bench, in its order, said that the main reason for filing the appeal is the NGT. The representatives of poultry farmers were not heard before the directions were passed on September 16, 2020 and December 10, 2021. “We give liberty to the petitioners to approach the NGT for modification of the directions,” the bench said, but clarified that it has not done so. expressed any opinion on the merits of the matter.
According to government data, the poultry sector in India, which is valued at around Rs 80,000 crore (2015-16), is broadly divided into two sub-sectors – a highly organized commercial sector with about 80 per cent of the total market share. % (eg, Rs 64,000 crore) and the other is unorganized and accounts for about 20% of the total market share at Rs. 16,000 crores.
The CPCB had earlier fixed the number of birds at 1 lakh for obtaining environmental clearance for a poultry farm. However, following the NGT’s 2017 directions, it revisited the guidelines and in August 2021 fixed the 25,000 bird limit for farms. But, the NGT lowered the limit of 5,000 birds and asked all those who have birds in excess of the limit, to obtain environment clearance by January 1, 2023.
NECC, the world’s largest association with a membership of over 35,000 poultry farmers, who have played a vital role in the betterment of the egg industry in India, said, “A poultry farm with a bird population of 35000-40000 and the said farmer becomes commercially profitable. Then he becomes completely dependent on the farm for his livelihood. The farmers of the small category (5000 to 25000 birds) are actually economically weak farmers with no significant income.”
