The next hearing in the matter will be held in the second week of March.

A bench of Justices DY Chandrachud and AS Bopanna gave this verdict. The bench, while reserving the verdict in the matter on Thursday after two days of hearing, had observed that its order would keep in mind the national interest and in view of the same, NEET counseling should start soon. The counseling for NEET PG courses has been put on hold due to the matter before the apex court.

Current norms will be applicable this year

Justice DY Chandrachud said a detailed interim order is required on the detailed EWS criteria for NEET PG 2021. It will take some time to submit it and prepare the order. Till then the existing norms for NEET PG EWS and OBC quota will be considered valid.

Pandey committee report accepted

The bench said that we accept the report of the Pandey committee. The counseling for NEET PG and UG will be conducted as per the NEET 2021 advertisement notification given in the office. Justice DY Chandrachud said the criteria laid down for identification of EWS for NEET PG and UG would be used. The report of the Pandey Committee shall be subject to the final validity of the matter.

Next hearing will be held on March 3

Justice Chandrachud while delivering the judgment said that we have upheld the constitutional validity of 27 percent reservation for OBCs in NEET PG and UG. This year’s applications for the 10 per cent EWS quota will be accepted and a final decision will likely be taken at the final EWS hearing to be held on March 3, 2022.
