MS Dhoni, over 1,800 Amrapali homebuyers asked to clear dues within 15 days

Mahendra Singh Dhoni, former Indian cricket captain, with 1,800 homebuyers amrapali Housing projects in Noida have been asked to clear dues in two weeks. The Supreme Court-appointed receiver, senior advocate R Venkataramani, asked the residents of the housing project to start making payments within 15 days of the issue of the notice, PTI reported. The allotment of flats booked by these homebuyers will be canceled if the homebuyer fails to register their name in the customer database which is being maintained by the receiver and if they also fail to make the payment within the stipulated time frame .

Dhoni He himself was not available for any comment, however, it should be noted that in April of 2016, the cricket star had resigned as the brand ambassador of Amrapali. A body called Amrapali Stalled Projects Investment Reconstruction Establishment (ASPIRE) was also formed to complete the stalled projects in Noida and Greater Noida region.

State-owned NBCC has been asked to complete the construction of over 20 housing projects with an estimated investment budget of over Rs 8,000 crore. The project is reportedly coming under the purview of a court-appointed committee.

After the Amrapali projects were taken over by the apex court, all home buyers were asked to register their details and pay the dues. This came after the court noted that these homebuyers had not taken any action regarding the matter after its judgment in July 2019. It was made public after a court-appointed receiver stated the purpose of this notice in an advertisement.

According to reports, coming back to the matter related to MS Dhoni, he had earlier booked two flats, C-P5 and C-P6 in the project in Sapphire Phase-I in Sector 45 Noida. It should also be noted that Arun Pandey, president of Rhiti Sports Management, the body that represents Dhoni, also has a flat in the project. If reports are to be believed, he has blocked Unit C-P4 in the same project. Like Dhoni, Pandey was also not available in this matter.

The appointed receiver will soon issue a separate notice to the buyers of projects in the Greater Noida region as well. Speaking on those mentioned in the list, the notice said, “Consequently, they are to be treated as defaulters and their units are liable to be cancelled.”

The notice also mentioned, “Failure to register in the customer data and start making payments within 15 days from this notice will automatically lead to cancellation of the allotment.”

Earlier, on August 14, 2021, the apex court had in fact warned about this, as it said it would issue 15 days notice to home buyers to pay the dues and register. It was to be issued to 9,538 buyers. Failing to meet the deadline, the flats will be treated as unsold and will be auctioned.

A bench of Justices UU Lalit and Ajay Rastogi said it will pass an order with regard to the issue after the home buyers’ counsel ML Lahoti submitted that they had earlier submitted a note showing flats booked under fake names. The need to resell has been pointed out. So that adequate funds can be raised for pending projects. This submission was supported by Venkataramani, who said that these home buyers may be given one last chance.

In July 2019, the apex court had settled a judgment that forced Amrapali Group out of prime locations in the NCR by terminating land leases. It was also barred from registering under the RERA Real Estate Act.
