Modi surname defamation case: The Gujarat High Court will hear today a plea challenging Rahul Gandhi’s conviction in a criminal defamation case over his “Modi surname” remark. Earlier on March 23, a metropolitan magistrate’s court in Surat formed the Congress after convicting him under sections 499 and 500 (criminal defamation) of the Indian Penal Code (IPC) in a 2019 case filed by the Bharatiya Janata Party (BJP). The chairman was sentenced to two years in prison. Gujarat MLA Purnesh Modi.

Following the verdict, Gandhi, who was elected to the Lok Sabha from Kerala’s Wayanad in 2019, was disqualified as an MP under the provisions of the Representation of the People Act.

The court had earlier refused to stay his sentence

Gandhi, 52, challenged the order in the Surat sessions court, seeking a stay on the sentence. Granting him bail, the court refused to stay the sentence on April 20.

The criminal defamation case against Rahul Gandhi was filed by Purnesh Modi over his ‘how can Modi be the surname of all thieves’. Remarks made during an election rally in Kolar, Karnataka on April 13, 2019.

Earlier on April 29, 2023, the Gujarat High Court adjourned the hearing till May 2 after senior advocate Abhishek Manu Singhvi, appearing for Rahul Gandhi, made lengthy arguments before the court today. He sought time for certain documents on record, following which the court allowed the same and adjourned the hearing till May 2.
