Man Gets 10 Yrs Imprisonment For Abducting, Raping Minor | Kanpur News – Times of India

Kanpur: Special judge Pocso Act court Kanpur Nagar Yogesh Kumar (II) ) on Friday sentenced accused Shiv Kishore alias Shipu alias Raj Dixit to ten years rigorous imprisonment and with a fin of Rs 45,000 for enticing, kidnapping and raping a minor girl.
The court in its order observed that fifty percent of the fine amount (Rs 22,500) be given to the victim for her medical treatment and rehabilitation.
Earlier, on the quantum of sentence, the defence had pleaded that since the accused was the only bread earner in his family, therefore, he should be punished with a minimum sentence. The prosecution, on the other hand, argued that the accused had kidnapped and physically exploited the victim against her will which was a heinous offence, therefore, he should be punished with a maximum sentence.
According to ADGC Vivek Shukla, the complainant, who is the father of the victim, had alleged in his complaint that around 4 pm on March 7, 2009, his 13-year-old daughter, who was a student of class VIII, had gone to her friend’s house to bring a book. When she did not return by 6 pm, he started tracking her.
But the victim in her statement recorded under section 164 Cr P C and in her examination-in-chief stated that Shiv Kumar alias Shipu, resident of Ghatampur was known to her and he had met her when she was going to her friend Komal’s house.
He enticed her and took her to the Jhakarkati bus station where he threatened to kill her if she raised an alarm. He had taken her to Mathura and stayed in a hotel where he physically exploited her. Later, he took her to Surat from where she was recovered by the police, the ADGC said.
The FIR was lodged against three persons– Deenanath Sharma, Shiv Kishore and Sonu Sharma but the court acquitted Deenanath Sharma and Sonu Sharma for want of evidence, the ADGC further said.
