Dismissing the appeal filed by the wife of the person against the order of the Family Court, court relied primarily on the fact that all criminal complaints and cases filed by the woman against her husband (who said her weight had come down from 74 kg to 53 kg) and her family were found to be false, which amounted to mental cruelty. .

The couple married in April 2012 and have a daughter.
The man’s case was that his wife was hot-tempered and expensive and had never tried to adjust to her family. According to him, she used to quarrel over petty matters due to which she felt humiliated in front of her family, but kept quiet in the hope that a good understanding would be built upon the respondent in future. But his behavior didn’t change. Alleging cruelty to his wife, the man claimed before the court that she weighed 74 kg at the time of marriage, but now weighs 53 kg.
Denying the allegations, the woman argued that she always carried out her marital obligations with love and respect. “It was the husband who never treated her with love and affection. Rather, he always treated her with cruelty. He never misbehaved with his in-laws,” read the woman’s plea. She also claimed that after six months of marriage, her husband and her family members started torturing and harassing her for dowry.
During the hearing, the HC observed that the woman had left her husband in 2016 and had also left her daughter at her in-laws’ house and never tried to meet him. It was also revealed that the husband’s family never demanded dowry and even paid for his higher education after marriage. The HC found that a false complaint was also filed by the woman against her husband and his family members.
