Live-in relationship between man, married woman ‘illegal’, says Rajasthan HC

The Rajasthan High Court recently issued an order terming the live-in relationship between a man and a married woman as “illegal”.

In the order issued on August 12, a single-judge bench of Justice Satish Kumar Sharma also rejected the request for police protection by the petitioners, who had said that she was a victim of domestic violence after which she left her husband’s house.

The petition was filed by a 30-year-old married woman and a 27-year-old man from Jhunjhunu district. During the hearing, counsel for the petitioners submitted that both the petitioners are adults and are in a live-in relationship with consent.

The petition states that the woman is married but is living separately due to physical abuse by her husband.

“It is clear from the scrutiny of all the documents of both the parties that the petitioner No. 1 is already married. She is not divorced but in spite of this, she is living in a live-in relationship with the petitioner No. 2. In such a scenario, both The live-in relationship between the two comes under the category of illicit relationship.

Passing the order, Justice Sharma also referred to a recent order of the Allahabad High Court, which had rejected the request for police protection in a similar case.
