Lakhimpur Kheri violence case: SC to hear today on Ashish Mishra’s plea for cancellation of bail

The Supreme Court will hear today i.e. on Wednesday on the petition seeking cancellation of bail of Ashish Mishra, son of Union Minister of State for Home Ajay Mishra Teni in the Lakhimpur Kheri case. Mishra is an accused in the case and was granted bail by the Allahabad High Court on February 10, 2022.

The matter will be heard by a bench headed by Chief Justice of India NV Ramana. The CJI said that the SC will constitute the same bench, which was earlier dealing with the issues arising out of the Lakhimpur Kheri incident.

On March 4, 2022, the SC agreed to consider the petition on March 11. However, it was rescheduled for March 16 due to an attack on a witness.

Advocate Prashant Bhushan, appearing for the petitioner, submitted that the key protected witness was attacked a few days after Mishra was granted bail. According to Bhushan, the alleged attackers also said that the petitioner will be “taken care of” as the BJP is back in power in the state.

The family members of the victims of Lakhimpur Kheri incident are the petitioners in the case. He moved the Supreme Court challenging the Allahabad High Court order, which had granted bail to Ashish Mishra.

BJP MP Ajay Mishra Teni’s son Ashish Mishra Teni had allegedly rammed his SUV on the protesting farmers. The incident resulted in the death of four farmers and a journalist due to violence in the region on October 3, 2021.

“The lack of any discussion in the High Court order with regard to the principles laid down for grant of bail is due to the lack of any substantive presentation by the State to the effect that the accused wields substantial influence over the State Government as his father is the same political Union ministers of the party that govern the state,” read the petition quoted by ANI.
