Kolkata Court on Nusrat Jahan and Nikhil Jain’s marriage: ‘Not legally valid’

A Kolkata court has declared the alleged Turkish marriage between actor-turned-Trinamool Congress MP Nusrat Jahan and city-based businessman Nikhil Jain as illegal.

Jain had filed a suit before the Alipore Court seeking a declaration that there was no marriage between him and Ms. Jahan.

“It is hereby declared that the alleged marriage between the plaintiff and the defendant in Bodrum, Turkey on 19/06/2019 is not legally valid,” Civil Judge S Roy of Alipore Second Court ordered on Tuesday.

The court, in its order, took note of Mr. Jain’s contention that he and Ms. Jahan had a wedding party in the presence of their close friends and relatives “following the Western and Indian style and customs of Hindu marriage”.

It was noted that the marriage was never registered in Turkey.

Mr Jain claimed that after returning to India, they began to live together, but relations between them later deteriorated and she was unwilling to continue the union.

It further claimed that the parties to the suit, one being a Hindu and the other a Muslim, never got married under the Special Marriage Act, “therefore the marriage with their consent cannot be treated as a marriage.”

The court also noted that Ms. Jahan prayed for a decision while accepting Mr. Jain’s arguments regarding the alleged marriage.

“Having considered all the aspects of the suit and having regard to the admission on the part of the respondent, the court is of the opinion that the alleged marriage between the parties is not legally valid,” the court directed. Dress.
