KCR wrote a letter to PM Modi, opposing the change in AIS rules

Telangana Chief Minister K Chandrasekhar Rao has written a letter to Prime Minister Narendra Modi expressing strong protest against the amendments proposed by the Union Government to the All India Services (Cadre) Rules, 1954.

He said in a letter that the proposed amendments are against the federal structure of the letter and spirit of the Constitution, and that the proposed amendments would also seriously destroy the All India Service character of the IAS, IPS and IFS.

The Chief Minister said that in view of the gravity of the work done by the officers of the All India Service in the States, the status and practice of the present rule provides for the concurrence of the State Governments in matters of deputation of officers to the Central Government and the proposed amendment would unilaterally harass tries. The above situation, with the Central Government assuming the power to take officers on deputation without the concurrence of the concerned officers or the State Government, is a dangerous move which is against the constitutional framework and spirit of cooperative federalism.

Rao also said that the proposal is clearly a step towards indirect control by the central government over the officers working in the states.

This amounts to interference in the functioning of the State Governments, targeted harassment and demoralization of the officers besides affecting the accountability of the officers to the State Governments. It will also make the state governments helpless in matters of AIS officers.

“I agree that the Parliament has enacted the All India Services Act, 1951 under the provisions of Article 312 of the Constitution and the Government of India has framed various rules under the said Act. However, I am the IAS, IPS, IFS Cadre Rules, 1954.” I strongly oppose the colorful use of the powers vested with the Government of India to harm the interests of the state and weaken the federal politics of the country.

“The proposed amendment to the All India Service Cadre Rules, 1954 is nothing but an amendment to the Constitution of India relating to Centre-State relations. Instead of such backdoor amendment of AIS rules, Govt. The Government of India must muster up the courage to amend the provisions by Parliament.”

He also mentioned that the present provisions of AIS Cadre Rules are sufficient to ensure harmonious and balanced deployment of officers.
